These Terms of Service (the “Terms”) are an agreement between you and Level Up Enterprises Ltd., a British Columbia company doing business as Online Kamloops (“Online Kamloops”, “we”, “us” or “our”). They apply when you use onlinekamloops.ca (the “Site”) or buy anything from us, including Website in a Box, our monthly services, digital products, courses and community memberships. Our Refund Policy and Privacy Policy form part of these Terms. Please read them before you order.

The short version

This summary is here to help. The full Terms below are what apply.

  • Prices are in Canadian dollars, and checkout shows the full price before you pay.
  • Digital products and courses are final sale once you have access to them.
  • Monthly services and memberships renew each month until you cancel. You can cancel at any time with no fee. You keep access until the end of the period you have paid for, and we don’t refund part-periods.
  • We don’t guarantee rankings, traffic or sales, because search engines, AI tools and social platforms are outside our control.
  • Nothing in these Terms takes away rights you have under consumer protection law.

1. Who we are

2. Accepting these Terms

You accept these Terms when you place an order, including by ticking a box or clicking a button to complete payment at checkout, or when you create an account with us. If you don’t agree, please don’t order.

If you order on behalf of a business or other organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization. You must have reached the age of majority where you live (19 in British Columbia) to buy from us.

Custom work we quote separately, such as a sales funnel, is governed by the written quote or agreement we send you together with these Terms. If a written agreement signed by both of us conflicts with these Terms, the signed agreement wins.

3. Orders, prices and payment

Before you pay, checkout shows what you are buying, the price of each item, any taxes or other charges, the total, and whether anything renews automatically. That information, these Terms and our Refund Policy make up our contract with you for that order. The contract is formed when your payment is confirmed.

Within 15 days of your order we send you a copy of your order details, normally straight away by email as your receipt. These Terms and our Refund Policy are linked from every page of the Site so you can view, save and print them, and we will send you a copy on request.

All prices are in Canadian dollars (CAD) unless we say otherwise. Where we are required to collect sales taxes (such as GST, PST or HST), they are added and shown at checkout.

Payments are processed by Stripe. We never see or store your full card number. When you subscribe, you authorize us, through Stripe, to charge your payment method at the start of each billing period until you cancel.

If a price on the Site is clearly wrong, we will tell you before we do any work and let you choose to go ahead at the correct price or cancel for a full refund. Promotional codes are subject to the conditions shown with them and can’t be exchanged for cash.

4. Website in a Box

What’s included. Website in a Box includes what our Services page describes at the time of your order: planning together (colours, logo, content and social media links), a build on an agreed schedule with revisions, and publishing your finished site. Anything not described there, such as extra pages, custom features, copywriting, photography, paid plugins, domain names, hosting and email, is outside the scope unless we agree to it in writing, and may be quoted separately.

Timing. After you order, we contact you within two business days to book a planning (kickoff) call. We start work within 30 days of your order, unless you ask for a later start. At the kickoff call we agree a schedule with you and confirm the target launch date in writing.

Your part. The build depends on you sending us content (such as text, logo and images), access to any accounts we need, and feedback when we ask for it. If these arrive late, the schedule moves by the same amount of time. If we don’t hear from you for 60 days despite our reminders, we may pause the project and restart it when you are ready, subject to our availability.

Revisions and approval. The build includes the revision rounds set out in the schedule we agree at kickoff. Changes beyond those, or changes to the agreed plan after the build has started, may be quoted separately. We ask you to review and approve the site before it goes live; launching the site at your approval completes the project.

Ownership. Once you have paid in full, you own the content you give us and the final design and content we create specifically for your site. Third-party components we use, such as WordPress, themes, plugins, fonts and stock images, remain subject to their own licences, which we pass on to you where we can. We keep ownership of our own tools, templates, methods and know-how, and grant you a permanent licence to use any of them that are part of your site, for your site.

Portfolio. We may show your finished site in our portfolio and marketing. Tell us if you would rather we didn’t.

Domains, hosting and email are separate products, ordered through our client portal and governed by the terms shown there.

5. Monthly services

Our monthly services are Search Engine Optimization (SEO), AI Optimization (AIO), Social Media Marketing and Website Management, as described on our Services page at the time you subscribe.

Billing and renewal. Monthly services are billed monthly in advance, starting on the day you order and then on the same day each month. Each month renews automatically for another month until you cancel.

Cancelling. You can cancel any service at any time, with no fee or penalty, from My Account (Manage Billing) or by emailing us. Cancellation takes effect at the end of the month you have already paid for: we keep providing the service until then, and you won’t be charged again. We don’t refund part of a month already paid for, except where the law requires it or our Refund Policy says otherwise.

No guaranteed results. Search engines, AI tools and social media platforms are run by third parties and change often. We work to improve your visibility, but we don’t guarantee any particular ranking, placement in AI answers, traffic, followers, leads or sales.

Your part. You give us the access we need (for example to your website, Google Business Profile or social accounts) and approve content we prepare for you. You are responsible for the accuracy of information about your business and for content you approve.

Changes to price or service. We will email you at least 30 days before a price increase or any other change that affects your subscription takes effect, explaining what is changing. You can cancel before the change takes effect, with no fee or penalty.

Failed payments. If a payment fails, Stripe will retry it and we will let you know. If it isn’t resolved within 14 days, we may pause the service until it is.

6. Digital products and courses

Digital products include downloadable guides, templates, checklists and other files. Courses are online lessons and materials we give you access to. Both are available as soon as your payment is confirmed, through the download link or your account.

Licence. We grant you a personal, non-exclusive, non-transferable licence to use digital products and courses for your own personal or internal business purposes. Please don’t resell, share, publish or redistribute them, share your course login, or use them to create a competing product. All other rights are ours or our licensors’.

Final sale. Because digital products and courses can’t be returned once you have access to them, all sales are final, except as set out in our Refund Policy (for example, if a file is faulty and we can’t fix it).

Rights of withdrawal. If you live somewhere that gives consumers a right to cancel online purchases within a set period (such as the 14-day right of withdrawal in the European Union and the United Kingdom), you ask us to supply digital content immediately when you complete your purchase, and you acknowledge that you lose that right once the download or access begins.

Course access. Course access lasts for the period stated on the course page. If we retire a course, we will give you at least 30 days’ notice so you can finish it and download any materials included with it.

7. Community memberships

A paid community membership is billed in advance for each period shown at checkout (for example, monthly) and renews automatically until you cancel. You can cancel at any time, with no fee or penalty. Your access continues until the end of the period you have paid for and then ends. We don’t refund part of a period.

Community rules. Be respectful. Don’t post anything unlawful, abusive, hateful, misleading or spam, don’t share other people’s personal information, and don’t share paid material outside the community. What you post stays yours, but you give us permission to host and display it to other members. We may remove posts that break these rules.

If you seriously or repeatedly break these rules, we may suspend or end your membership, and the current period won’t be refunded. If we close the community or end your membership for any other reason, we will refund the unused part of your current period.

8. Consultations

Free consultations are booked through our online scheduling page. They are free and you have no obligation to buy anything. If you can’t make it, please reschedule or let us know. If we offer paid sessions, the rescheduling and cancellation terms are shown when you book.

9. Using the Site

Please don’t misuse the Site: don’t try to break or overload it, gain access to areas or accounts that aren’t yours, upload malicious code, or use it for anything unlawful. If you have an account, keep your login details secure; you are responsible for activity under your account.

The Site and its content, including text, graphics, logos, guides and courses, belong to us or our licensors and are protected by copyright and trademark law. Links to other websites are provided for convenience; we aren’t responsible for their content or practices.

10. Materials you give us

You confirm that you own or have permission to use everything you send us, such as text, logos, images and account access, and that using it for your project won’t infringe anyone’s rights or break the law. You give us permission to use those materials to provide our services to you. If you are buying for a business, you agree to compensate us for losses caused by a third-party claim that your materials infringe their rights.

11. Third-party services

Our work relies on services run by others, such as Stripe, hosting providers, WordPress and its plugins, Google, Meta and AI providers. Their own terms apply to your use of them. We aren’t responsible for their outages, policy or algorithm changes, or decisions they make about your accounts.

12. Our commitment and its limits

We provide our services with reasonable care and skill. Information on the Site and in our blog, guides and courses is general information, not legal, financial, tax or other professional advice. Apart from what these Terms say and what the law requires, the Site and our products are provided “as is”, without other promises or warranties.

13. Limitation of liability

To the extent the law allows: (a) we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data, goodwill or business opportunity; and (b) our total liability for any claim relating to these Terms or anything we supply is limited to the amount you paid us for the product or service the claim relates to, in the 12 months before the claim arose.

Nothing in these Terms limits our liability for fraud, gross negligence or wilful misconduct, for death or personal injury caused by our negligence, or for anything else that can’t be limited by law.

14. Your rights as a consumer

If you buy as a consumer (for personal, family or household purposes), you have rights under consumer protection laws, including British Columbia’s Business Practices and Consumer Protection Act and the laws of the place where you live, that a contract can’t take away. Nothing in these Terms limits those rights, and where any part of these Terms conflicts with them, those rights apply instead.

15. Suspension and ending

We may suspend or end your access to the Site or a service if you seriously breach these Terms, don’t pay, or use our services unlawfully. Where it is reasonable to do so, we will tell you first and give you a chance to put things right. Parts of these Terms that by their nature should continue, such as ownership, licences, limitation of liability and governing law, continue after they end.

16. Changes to these Terms

We may update these Terms from time to time, and the date at the top of this page shows the latest version. The version in effect when you place an order applies to that order. For subscriptions and memberships, we will email you at least 30 days before a change that affects you takes effect, with the updated terms and a plain-language explanation of what is changing. You can cancel before the change takes effect with no fee or penalty.

17. Governing law and disputes

If something goes wrong, please contact us first. Most problems can be sorted out quickly.

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Claims may be brought in the courts of British Columbia or, where it has jurisdiction, the Civil Resolution Tribunal. If you are buying for a business, you agree to the exclusive jurisdiction of those courts. If you are a consumer, you may also bring a claim in the courts where you live if the law there allows it, and you keep the protection of the mandatory laws of that place. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. General

  • Whole agreement. These Terms, the order details shown at checkout and any written agreement signed by both of us are the whole agreement between us about your order.
  • Severability. If a court finds part of these Terms unenforceable, that part is limited as little as necessary and the rest stays in effect.
  • No waiver. If we don’t enforce a right straight away, we can still enforce it later.
  • Transfer. You can’t transfer your rights under these Terms without our consent. We may transfer ours to a business that takes over our services, and we will tell you if we do. This doesn’t affect your rights as a consumer.
  • Events beyond our control. We aren’t responsible for delays caused by events beyond our reasonable control. We will tell you and keep the delay as short as we can. If a delay lasts more than 30 days, you can cancel the affected service and get a refund for anything you paid for but didn’t receive.
  • Notices. We send notices, receipts and copies of contracts by email to the address you gave us, and you can reach us at onlinekamloops@levelupenterprises.ca. You agree to receive them electronically.
  • Language. These Terms are written in English. If we provide a translation, the English version applies to the extent the law allows.
